These Terms and Conditions ("Terms") govern your use of the website https://www.jivanshailee.com and the JivanShailee mobile application (collectively, the "Service"), operated by Dahikar Technologies Private Limited ("Company", "we", "us", or "our"), a company incorporated under the Companies Act, 2013, with its registered office in Nagpur, Maharashtra, India.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Important Medical Disclaimer

JivanShailee is a holistic wellness tool, not a medical device. The "AI Therapist," "Vedic Healing," and other features are designed for emotional support, self-improvement, and relaxation. They are not a substitute for professional medical advice, diagnosis, or treatment.

  • Not for Crisis: If you are experiencing a medical emergency, severe mental health crisis, or thoughts of self-harm, please contact a professional doctor or emergency services immediately.

  • No Doctor-Patient Relationship: Use of this app does not create a doctor-patient relationship between you and Dahikar Technologies Private Limited.

2. User Accounts

To access premium features, you may be required to create an account. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to provide accurate and complete information during registration.

3. Subscriptions and Payments

  • Free Trial: We offer a 3-day free trial for new users.

  • Billing: Subscription fees are billed in advance on a recurring basis (monthly or yearly) ending the trial period.

  • Refunds: As stated in our Refund Policy, we do not offer refunds once the trial period ends and a charge has been processed, except where required by law.

  • Cancellations: You may cancel your subscription at any time via your App Store or Play Store settings.

4. Intellectual Property

The Service and its original content (including but not limited to the "Life Blueprint" algorithms, Vedic audio tracks, logos, and visual design) are and will remain the exclusive property of Dahikar Technologies Private Limited. The Service is protected by copyright, trademark, and other laws of India and foreign countries.

5. User-Generated Content

  • Journaling & Chat: Data you enter into the "Journal" or share with the "AI Therapist" is private to you. We do not sell your personal conversations to third parties.

  • License: By posting content (e.g., feedback), you grant us the right to use it to improve the Service, but this does not apply to your private health/mood data.

6. Limitation of Liability

In no event shall Dahikar Technologies Private Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;

  • Any content obtained from the Service;

  • Unauthorized access, use, or alteration of your transmissions or content.

7. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

  • Dispute Resolution: Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of Nagpur, Maharashtra, India.

  • Exclusive Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra for the resolution of any disputes.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
